Every successful regulatory submission for a New Approach Methodology (NAM) qualification is built around a clear, precise Context of Use (COU). The FDA, EMA, and OECD all emphasize that without a defined COU, even the most advanced models, assays, or AI-based tools cannot progress toward regulatory acceptance through programs like the FDA’s ISTAND.


Why “Context of Use” Matters in NAM Qualification

A COU defines precisely what your NAM is intended to do and how it will be used in drug development or regulatory decision-making. It is the foundation of every validation and qualification effort. Without it, there is no way to assess whether a method is reliable, relevant, or ready for adoption in the regulatory context.

A strong COU clarifies:

  • The purpose of the NAM and what question it answers
  • The scope and limitations of its application

Note that a NAM’s design is centered around a need (gap) in drug development. Once the capabilities of the technology are established, that need informs the COU. Every subsequent stage focuses on how that need is satisfied by your COU.

How COU Strengthens Validation and Qualification

When developing a NAM, the COU sets the benchmark for every study that follows. It determines:

  • What performance data is needed to prove reliability and relevance
  • Which regulatory expectations apply under the FDA’s ISTAND or EMA’s QoNM framework
  • How to structure validation studies to ensure your NAM consistently satisfies its intended purpose

Without a COU, validation becomes unfocused and qualification impossible. Regulators evaluate the fit-for-purpose of your NAM based entirely on how clearly it fulfills the stated COU.


The Competitive Edge of a Well-Defined COU

In the evolving landscape of regulatory science, the first technologies to achieve qualification within a specific COU gain a distinct competitive advantage. Once a NAM is qualified for a particular application, similar technologies are measured against it. That means companies developing comparable platforms without a qualified COU risk being left behind.

Furthermore, a COU can also define that a specific scientific question be probed by their category of NAMs. For example, a COU may specify that human-relevant DILI should be investigated with adequately cultured, human-derived primary hepatocyte spheroids. Existing traditional methods (NHP liver studies, etc.) or pre-qualification competing NAM methods (liver-on-a-chip, stem cell-derived liver organoids, etc.) would now face significant headwinds in their use by drug developers.
